Background

Jharkhand Janadhikar Parishad (JJM) comprises of many LWE, far left and left political organizations. It was established in October 2018 to bring together organizations (mainly working in Jharkhand) to spread a particular fundamentalist ideology. Urban Naxalite Stan Swamy was also his member who died last year. A meeting was held on 11 August 2018 in which more than 100 colleagues from more than 50 organizations participated. Observation

1. Jharkhand Janadhikar Parishad (JJM) is a center point or Junction of many LWE organizations.

 

2. JJM works with both Maoist and Christian missionary organizations.

 

3. JJM is the mouthpiece for Hemant Soren and these people helped Hemant to win the election. After the formation of the Hemant government, they are getting anti-people work according to their mind.[PIC 9]

 

4. Stan Swami also used to be an active member of this organization before going to jail and dying. These people gathered other organizations in the urban area of Jharkhand and gave cover to Maoists. When government acts against them, it ensures the participation of the general public in the war against the state and provides moral support to the public.

 

5. JJM opposed the Development projects or works in the guise of protecting the interest of Adivasis. These organizations muster the organized opposition to the development projects. Simultaneously in the same breath, they clamour at the top of their voice that Government is not doing any development in the tribal area.

 

6. JJM sends their representative to Gram Sabha, which comes under the PESA, and they influence the Sabha to pass a resolution against any development project and send those passed resolutions to the Government.

 

7. JJM uses these Constitutional Act to spread propaganda and misinformation-

a. PESA act.

b. Chotanagpur Tenancy Act (CNT) and the Santhal Pargana Tenancy Act (SPT)

c. Sedition Laws like - UAPA, NSA and section 124A of IPC

 

8. They have some particular propaganda demands like -

• Withdrawal of Bhima Koregaon cases and immediate release of Urban Naxals arrested in these.
• The central government should immediately end the politics of religious majoritarianism.
• Removal of Police Camp from Khunti Schools.
• The decision of the Jharkhand government to withdraw the Pathalgadi cases should be followed immediately.
• Caste Based Census.

• CAA, NRC व NPR को केंद्र सरकार रद्द करें. झारखंड सरकार इन्हें लागू न करने की स्पष्ट प्रतिबद्धता दर्शाए एवं इन्हें रद्द करवाने के लिए संघर्ष करे। 

• भूमि अधिग्रहण संशोधन कानून 2018 (झारखंड) व लैंड बैंक नीति को रद्द की जाए। भूमि कानूनों में किसी प्रकार के जन व ग्राम सभा विरोधी संशोधन न किए जाए। इन नीतियों के तहत ली गयी अथवा चिन्हित की गयी ज़मीन को तुरंत ज़मीन मालिक / ग्राम सभा को लौटाई जाए।
• कोयला व अन्य खनिजों के व्यवसायिक खनन के निर्णय को वापिस लिया जाए. खनन पूर्ण होने के बाद खानों का पुनरुद्धार कर भूमि मालिक को ज़मीन वापसी सुनिश्चित किया जाए।
• ईचा खरकाई बाँध, गोड्डा अडाणी प्रोजेक्ट, पलामू हाथी कारीडोर, मंडल डैम एवं ऐसी सभी परियोजनाओं को रद्द किया जाए जो ग्राम सभा की सहमति के बिना एवं भूमि कानूनों का उलंघन कर स्थापित किए जा रहे हैं।
• पाँचवीं अनुसूची के प्रावधान और पेसा कानून को पूर्ण रूप से लागू किया जाए व नियमावली बनायी जाई। ग्रामसभा की शक्तियों और भूमिकाओं पर अतिक्रमण करने वाले सारी समितियों, क्लबों एवं प्रशासनिक आदेशों को रद्द किया जाय।
• वनाधिकार कानून को पूर्ण रूप से लागू किया जाए और निजी व सामुदायिक पट्टों के सभी दावों को स्वीकार किया जाए।

• अभिव्यक्ति की स्वतंत्रता के दमन और सामाजिक कार्यकर्ताओं को प्रताड़ित करने के लिए प्रयोग किए जा रहे सब कानूनों को तुरंत निरस्त किया जाए। उदहारण के लिए भारतीय दण्ड संहिता की धारा 124क (राजद्रोह) एवं धारा 499 (मानहानि), विधिविरुद्ध क्रिया-कलाप (निवारण) अधिनियम (UAPA) एवं राष्ट्रीय सुरक्षा अधिनियम (NSA) NIA एक्ट को रद्द किया जाए झारखंड में UAPA व राजद्रोह धारा का इस्तेमाल और पुलिसिया दमन पूर्णता: बंद हो. झारखंड में कथित राष्ट्रविरोधी गतिविधियों के लिए दर्ज सारे मामलों को वापस लिया जाए।
• सभी राजनैतिक बंदियों और लम्बे समय से जेलबन्द विचाराधीन कैदियों की तुरंत रिहाई की जाए। पीड़ित विचारधीन कैदियों के परिवारों को मुआवज़ा मिले एवं गलत मामला दर्ज करने के लिए दोषी प्रशासनिक व पुलिस पदाधिकारियों पर कार्यवाई हो।
• खूँटी में पत्थलगड़ी को संविधान विरोधी करार कर उसके नाम पर प्रशासनिक और सुरक्षा बलों द्वारा किए जा रहे अत्याचार को तत्काल रोका जाए, सारे मुकदमों की वापसी, पुलिस कैंपों की वापसी, पीड़ितों को मुआवजा एवं दमन के दोषी अधिकारियों पर कार्रवाई सुनिश्चित की जाए।
• नक्सल विरोधी अभियानों की आड़ में सुरक्षा बलों द्वारा लोगों को परेशान न किया जाए. मानवाधिकार उल्लंघन के मामलों को सख्ती से निपटाया जाय. निर्जीव पड़े हुए राज्य मानवाधिकार आयोग को पुनर्जीवित किया जाय और यह जनता के लिए सुलभ हो. मानवाधिकार उल्लंघन मामलों के लिए स्वतंत्र शिकायत निवारण तंत्र बनाया जाय।
• सारी असामयिक मौतों (भूख, कुपोषण आदि से) तथा हत्याओं (लिंचिंग, हिरासती, मुठभेड़ आदि में) की न्यायिक जांच हो, एक साल में इनकी जिम्मेवारी निर्धारित की जाए और आवश्यक कार्रवाई की जाए मृतकों के परिवारों को कम-से-कम 25 लाख रु का मुआवज़ा मिले । मॉब लिंचिंग के विरुद्ध विशेष कानून बने एवं सर्वोच्च न्यायलय के वर्तमान गाइडलाइन्स को लागू किया जाए।
• विशेष लैंगिक नीति बनायीं जाए और लागू की जाए। महिला आयोग को पुनर्जीवित किया जाए।

• राज्य की वर्तमान स्थानीयता नीति रद्द की जाए एवं झारखंड में जिनका मूल गाँव है, केवल ऐसे लोगों को बुनियादी स्थानीय मानने की नीति बनाई जाए। हर स्तर की निजी और सरकारी नौकरियों में नेतृत्व व निर्णायक पदों पर स्थानीय लोगों की अधिकांश भागीदारी सुनिश्चित करने के लिए कानून बनाया जाए।
• देश में जातीय जनगणना करवाई जाए सरकारी नौकरियों में दलित, आदिवासी व पिछड़े वर्ग की आरक्षण सीमा को 50% से बढ़ाया जाए। प्रोन्नति में इन समुदायों का कम से कम 50% आरक्षण सुनिश्चित किया जाए। महिलाओं के लिए हर क्षेत्र में कम-से-कम 33% आरक्षण लागू किया जाए। सभी विभागों के रिक्त पदों को तुरंत भरा जाए।
• आर्थिक रूप से कमजोर वर्ग के लिए 10% आरक्षण (जो मुख्यतः सवर्णों के लिए आरक्षण व्यवस्था है) को समाप्त किया जाए, क्योंकि यह नीति आरक्षण व सामाजिक न्याय के मूल सिद्धांतों के विरुद्ध है।

• सभी जन कल्याणकारी योजनाओं एवं सरकारी सुविधाओं में आधार की अनिवार्यता समाप्त की जाए।
• जन वितरण प्रणाली में कम से कम 7 किलो अनाज प्रति व्यक्ति, दाल और खाद्यान तेल मिले; दाल-भात केन्द्रों का विस्तार और उनकी गुणवत्ता में सुधार हो; सभी वृद्ध, विकलांग व्यक्तियों, एकल महिलाओं व आदिम जनजाति परिवारों को कम-से-कम 3000रु की मासिक पेंशन मिले; सभी गर्भवती व धात्री महिलाओं को बिना किसी शर्त 6000 रु का मातृत्व लाभ मिले; आंगनवाड़ियों व विद्यालयों के मध्याह्न भोजन में सभी बच्चों को पर्याप्त पोषण-युक्त पका खाना, पोषाहार व प्रति सप्ताह 6 अंडे मिले।
• शिक्षा के अधिकार का दायरा बढ़ाया जाए और सभी बच्चों के लिए 12वीं कक्षा तक की शिक्षा समान तथा निःशुल्क की जाए। विशेष रूप से प्राथमिक शिक्षा की गुणवत्ता में सुधार | विद्यालयों के विलय के फैसले को वापस लिया जाए और बंद विद्यालयों को फिर से शुरू किया जाए। निजी विद्यालयों और कालेजों की फीस पर नियंत्रण की कारगर व्यवस्था बनायीं जाए। नई शिक्षा नीति को लागू न किया जाए एवं शिक्षा के व्यवसायीकरण पर नियंत्रण हो।
• आयुष्मान भारत के माध्यम से निजी अस्पतालों और बिमा कंपनियों को फ़ाएदा दिलाने के बजाए सरकारी सार्वजानिक स्वास्थ्य सेवा प्रणाली द्वारा सभी के लिए समान गुणवत्तापूर्ण और निःशुल्क स्वास्थ्य सुविधाएँ उपलब्ध करवाया जाए। प्राथमिक व निवारक स्वास्थ्य सेवाओं को सुदृढ़ किया जाए।
• विशेष रूप से कमजोर जनजातीय समूह के पूर्ण भोजन, पोषण, शिक्षा, स्वास्थ्य व रोज़गार के लिए विशेष व्यवस्था लागू की जाए।

• स्वामीनाथन समिति की सभी अनुशंसाओं को पूर्ण रूप से लागू किया जाए एवं सभी कृषि उत्पादों की C2 लागत से कम-से-कम 50% अधिक न्यूनतम समर्थन मूल्य तय किया जाए। झारखंड की पारंपरिक फसलों जैसे मरुआ तेलहन, दलहन की खेती को प्रत्साहन दिया जाए एवं पारंपरिक बीजों का संरक्षण किया जाए। तीनों कृषि कानूनों को रद्द की जाए।
• झारखंड के गोवंशीय पशु हत्या प्रतिषेध अधिनियम को रद्द किया जाए और मवेशियों के व्यापार पर प्रतिबन्ध हटाए जाए।
• वर्षा जल व नदियों, नालों व वर्तमान डैमों पर आधारित सिंचाई की व्यवस्था सुनिश्चित की जाए एवं सिंचाई प्रथमत: ग्रामसभा और द्वितीयक स्तर पर पंचायती राज संस्थानों के जिम्मे की जाए। सभी वन उपज का नियंत्रण ग्राम सभा को दिया जाए।
• रोज़गार के अधिकार का विस्तार शहरी क्षेत्रों में भी हो और कुशल मज़दूरी को भी इसके दायरे में लाया जाए। नरेगा में काम की गारंटी 200 दिन की जाए, मज़दूरी कम-से-कम 600 रु प्रतिदिन हो और भुगतान समय पर हो।
• प्रवासी मज़दूरों का पंजीकरण हो एवं सभी मज़दूरों के सम्मानजनक मज़दूरी काम करने का माहौल, रहने की सुविधा व पर्याप्त सामाजिक सुरक्षा के अधिकारों का अनुपालन हो।
• घरेलु कामगारों के अधिकारों के लिए कानून बनाया जाए एवं ILO के नियमों का पूर्ण पालन सुनिश्चित किया जाए।

• झारखंड धर्म स्वातंत्र्य कानून को रद्द किया जाए एवं सरना या अन्य किसी नाम के स्वतंत्र आदिवासी धर्म को मान्यता दी जाए।
• झारखंड की अपनी आदिवासी एवं आंचलिक भाषाओं को सरकारी कामकाज की भाषा एवं सरकारी विद्यालयों में शिक्षा का अतिरिक्त माध्यम बनाया जाए।
• सच्चर कमेटी की अनुशंसाओं के आधार पर अल्पसंख्यक समुदाय के चहुमुखी विकास के लिए विशेष नीति बनायी जाए। साथ ही, अल्पसंख्यक समुदाय के लिए अलग बजट का प्रावधान हो।

• झारखंड में सक्रिय विकेंद्रीकृत शिकायत निवारण प्रणाली की स्थापना की जाए। राज्य में सूचना का अधिकार आवेदन देने की ऑनलाइन सुविधा शुरू की जाए।

3. Two months ago, these people raised the issue regarding the trees being cut in the Raja Dera forest. You will be shocked to know that this area is very Naxal affected and they are not worried about the environment. They are concerned that the Naxalites will not get a place to hide. 7. List of Event done for Stan Swamy by JJM - Protest after LWE Stan Swamy Death

Event 1 - Mass Convention was organized on 28 August 2021 by Shaheed Father Stan Swami Nyay Morcha at SDC Hall Purulia Road, Ranchi from 11 am.

Event 2 - Sankalp Sabha was organized on 15 August 2021 at Birsa Munda Samadhi Sthal in Ranchi.

Event 3 - On the eve of Independence Day on 14 August 2021, Father Stan Swami Nyay Morcha and activists of various mass organizations organized Albert Ekka Chowk, Ranchi. Bhuvneshwar Kevat, Sushanto Mukherjee, Elena Horo, Sohail Ansari, Aloka Kujur, Praful Linda, Binod Kumar, Praveer Peter, Ph. Tony, Peter Martin, Akash Ranjan, Virendra, Arvind Avinash, Bharat Bhushan Choudhary, Punita Topno, Mukta Kujur etc. were mainly present.

Event 4 - Many people formed a human chain for Stan Swami in Ranchi on 23 July 2021.

The participants in the human chain made an attached letter to the Governor in which the following demands have been made -

• Stan Swamy gets justice.
• Repeal all repressive laws including, UAPA, sedition section.
• All political prisoners should be released.
• The process of bale should be fully established so that getting bale is not unusual.
• The families of the undertrial prisoners should get compensation and action should be taken against the guilty administrative and police officials for registering wrong cases.
• Jharkhand government should immediately cancel all the cases imposed on all the tribal-indigenous people including Stan Swamy during the Pathalgadi movement.
• Use of UAPA and sedition section and police repression in Jharkhand should be completely stopped.

8. JJM raised the issue of setting up CRPF camps in tribal areas and removing those engaged. These motives would have revealed their modus operandi as it harms the Naxalites. When there are CRPF camps, the activity of Naxalites decreases in the tribal area.[PIC 4]
